What is the Current Status of the Six-Week Abortion Ban?

As of 9/14/22, Ohio has put a temporary injunction on a ban requiring patients to undergo tests that detect fetal heart tones prior to an abortion. We are able to serve patients through 21 weeks and 6 days gestation until further notice.

There are no current challenges to this injunction. On 12/7/2023, the Right to Reproductive Freedom Amendment went into effect, protecting reproductive choices including abortion.

Ohio abortion providers are pursuing a permanent injunction against the six-week abortion ban.

 What is the Current Status of Mifepristone?

As of right now, mifepristone can still be used in medication abortions up through nine weeks in Ohio. Mifepristone can also be used in miscarriage management.

On 03/26/2024, the Supreme Court heard oral arguments in FDA vs. Alliance for Hippocratic Medicine, where the Alliance for Hippocratic Medicine and other anti-abortion groups argued that the current regulations around Mifepristone were unsafe. We will not hear a ruling in this case until later this year.

Are There Other Lawsuits Regarding Abortion?

On 3/29/2024, the ACLU of Ohio filed a lawsuit on behalf of abortion providers challenging the 24-hour waiting period restriction.

In Ohio, patients must have an in-person consultation 24-hours before they are allowed to receive an abortion. This same law requires abortion providers to hand out state-mandated materials that discourage the patient from proceeding with their abortion. There is no medical need for these materials or the 24-hour waiting period.

The lawsuit argues that, under The Right to Reproductive Freedom with Exceptions for Health and Safety Amendment, the 24-hour waiting period restriction is unconstitutional as it creates an undo burden on patients that prevents them from easily accessing reproductive healthcare.

Abortion providers are seeking a temporary injunction while the case plays out in court. As of right now, that request has not been granted and the 24-hour waiting period (and all related restrictions) remains in place.

Period Tracking

Even though abortion is legal in Ohio, tracking your period can still be a helpful tool to prevent pregnancy. It can help ensure you get reproductive care, like abortion, within the timeframe permitted by Ohio law. A missed period is often the first indication of pregnancy, so knowing if your period is late will become important in ensuring you can receive timely reproductive care.

Below is a list of resources you can use to help track your period. We know that there are concerns about period tracking phone apps collecting your data, which could be used as evidence against you should abortion become illegal. All resources listed below are either analog or digital apps whose privacy policies state that they are committed to not storing, selling, or giving away any of your period tracking data.

  • Euki - A free period tracking phone app that provides comprehensive sexual and reproductive health information as well as period tracking all in one place, without stigma or worry of sharing your data with third parties (see their privacy policy here). 

  • Cycle Journal - A physical journal (purchase required) with templates to manually write out your period cycles. The journals contain symptom trackers, steps to predict your next cycle, and prompts to understand yourself and your period. Cost varies per journal.

  • Period tracking templates - Free printable templates that you can customize to track your monthly cycles. 

Pregnancy Tests

Taking pregnancy tests once or twice a month can help prevent unwanted pregnancies. You can order pregnancy tests online, buy them from a local grocery or drug store, and even get them for free at some clinics, including Preterm. If your test comes back positive, reach out to Preterm, or the other health care providers listed on this site to figure out the next steps that are right for you.
